Sanctions
The CTS Ethics and Disciplinary Committee (the Committee) is guided by the CTS Code of Ethics and Conduct (the Code), and by the Rules and Procedures of the Code regarding ethical and professional discipline complaints. The Committee is charged with the investigation and action of possible violations of the Code to ensure that any person who has applied for, or has been awarded certification, is practicing in accordance with professional and community standards, and to protect the public against unprofessional and unethical conduct by CTS applicants/certificants. Based upon the guidelines noted above, below is a list of current case actions and sanctions taken by the Committee:
Case Number 2008-2
Facts: The CTS Ethics and Disciplinary Committee received information that indicated a CTS holder had admitted to and pled guilty to a Federal felony of Commercial Bribery.
Procedure: In accordance with the CTS Code of Conduct and Rules and Procedures Regarding Ethical and Professional Discipline Complaints, the Ethics and Disciplinary Committee conducted a preliminary analysis of the information and available documentation. Determining that the case warranted further analysis, the Committee contacted the certified individual to further investigate the allegations. The certified individual was provided with notice and an opportunity to be heard before the committee. The Committee considered all evidence before it in making a determination.
Findings: The Committee found that Mr. Jay W. Armand had committed the following violations of the Code:
- Failure to meet standards of honesty and integrity
- Failure to conduct oneself in a manner that reflects favorably upon the profession
- Failure to create an ethical climate
- Failure to ensure adherence to the law at all times
- Compromise of professional judgment
Actions: The Committee, as a result, took the following action:
It is the determination of the CTS Ethics and Disciplinary Committee that Mr. Jay W. Armand is ineligible to hold or apply for any CTS certification for a period of five years effective October 23, 2008, ending October 23, 2013.
